Dynegy Cash Rewards Program Terms and Conditions

The following terms and conditions apply to you when you enroll into the Dynegy Cash Rewards Program (the “Program”).  The Program begins on the first day of your first billing cycle of service with Dynegy Energy Services (East), LLC d/b/a Dynegy or Dynegy Energy Services, LLC d/b/a Dynegy (“Dynegy”) and ends at the end of the Initial Term (the “Program Period”).  During the Program Period, you will earn as a cash back reward the percentage of your electricity supply costs stated on your Welcome or Service Plan change letter, as the case may be (your “Reward”).  Your Reward is calculated on your total Dynegy supply costs less any taxes or fees, including but not limited to purchase of receivables fees.  In order to earn and receive your Reward, your account must not have a past due balance and you must have been continuously enrolled in the Program during the Program Period with the same utility account number (the “Qualification Requirements”). If you are on budget billing, your Reward will be calculated on your actual usage.  Dynegy may on a case-by-case basis incorporate cancelled and rebilled charges that are received by Dynegy after the end of the Program Period into the Reward calculation, however, Dynegy is in no way obligated to do so.  

Within 8-12 weeks following the end of the Program Period, Dynegy will calculate your Reward and issue a prepaid debit card or check.  Your Reward will be issued in the name of the account holder on file with the utility and sent via USPS to the mailing address on file.  You are responsible for updating your mailing address on file with Dynegy and understand that failure to do so may result in non-receipt of your Reward.  If your Program Period is greater than twelve months, Dynegy will calculate your Reward annually from your enrollment date until the end of the Program Period. Any tax liability relating to the Program is your sole responsibility. Dynegy shall not be responsible for resolving any conflicting claims to the Program.  You have no property right or interest in your Reward until you have met the Qualification Requirements and received your Reward. 

Dynegy is not responsible or liable for, and is under no obligation to re-issue a prepaid debit card that is lost, damaged or stolen, unless required by applicable law.  Please refer to card issuer Terms and Conditions for details.  Dynegy reserves the right to otherwise modify or terminate the Program without notice at any time at its sole discretion. If Dynegy terminates the Program, you will be eligible for a pro-rated reward based on the portion of your Program Period that has been completed.  In the event that all or part of the Program is found to be in violation of applicable law, then Dynegy shall have no obligations to fulfill the Program.
